Terms and Conditions

Effective Date: 04.10.2025

Welcome to EditHouse On Demand (“EditHouse”, “we”, “our”, or “us”), a video streaming and e-commerce platform that enables creators to rent and sell films, livestream events, and offer physical media and merchandise through an embeddable video player.

By accessing or using our platform and services, you (“user”, “you”, “filmmaker”, “producer”, or “subscriber”) agree to be bound by these Terms and Conditions. If you do not agree, please do not use the platform.

1. Overview of Subscription Plans

EditHouse offers three annual subscription plans designed for independent filmmakers, event producers, and media distributors:

1.1 Movie Plan

  • Upload and monetize one (1) film.

  • Offer rental access to your film.

  • Sell CDs, DVDs, Blu-rays, and merchandise via the embeddable player.

1.2 Live Plan

  • Host and monetize live streaming events.

  • Convert livestreams into video-on-demand (VOD) rentals.

  • Sell physical media and merchandise via the embeddable player.

1.3 Producer Plan

  • Upload and monetize up to ten (10) films.

  • Includes all features of the Movie Plan, including rentals and physical product sales.

2. User Responsibilities

  • You confirm that any content uploaded to EditHouse, whether live or on demand, is owned by you or that you have obtained all necessary rights, licenses, and permissions to distribute and monetize it.

  • You are solely responsible for ensuring your content complies with all applicable copyright and intellectual property laws.

  • You must not upload content that is illegal, defamatory, obscene, infringing, or otherwise violates any law or platform policy.

  • You must provide accurate information in your account and must not impersonate any person or entity.

3. Sales and Payments

  • EditHouse takes a 10% commission on the profit margin from all live streaming rentals and on-demand video rentals.

  • EditHouse takes a 20% commission on the profit margin from the sale of physical products, including CDs, DVDs, Blu-rays, and merchandise.

  • Profit margin is defined as the revenue remaining after deducting Value-Added Tax (VAT), production, fulfillment, shipping, and other direct costs from the gross sale amount.

  • VAT is charged at the applicable rate based on the customer’s country of purchase and is deducted from the total sale amount before profit is calculated.

  • Payouts are processed through supported platforms (e.g., PayPal, Stripe), and may be subject to third-party transaction fees and payout schedules.

  • Sellers are responsible for fulfilling orders, managing stock, and handling any customs duties, returns, or customer inquiries related to physical products.

4. Content Moderation and Removal

EditHouse reserves the right to remove or disable access to any content at its sole discretion if:

  • The content is found to infringe copyright or intellectual property rights.

  • The user fails to provide proof of ownership or authorization.

  • The content is deemed to violate any applicable laws or EditHouse policies.

  • A formal legal complaint or takedown request (e.g., DMCA notice) is received.

We may suspend or terminate your subscription or account without notice or refund in such cases.

5. Cancellations, Refunds & Cooling-Off Rights

5.1 Subscription plans (Movie, Live, Producer)

  • Business users (default): EditHouse On Demand subscription plans are intended for business users (filmmakers/producers). For B2B subscriptions, fees are non-refundable, except where (a) required by law, (b) we terminate without cause, or (c) there is a proven duplicate or erroneous charge.

  • Consumers (if applicable): If a subscriber qualifies as a consumer under UK law, they may have a 14-day cooling-off right for distance contracts. Where applicable, we will honor that right. If the subscriber asks for the service to start immediately (e.g., by publishing content, enabling paywalls, or using live features) and acknowledges losing the cooling-off right, the cooling-off refund does not apply after service begins.

  • Material failure on our side: If EditHouse fails to provide the subscribed service for a material and continuous period not caused by you or a third party (e.g., extended outage), we may issue a pro-rata credit or refund for the affected period.

5.2 VOD rentals & livestream access sold to customers (digital content)

  • Cooling-off: Customers generally have a 14-day cancellation right for distance contracts, but this right can be lost once digital content streaming begins if the customer gave explicit consent and acknowledged this loss at checkout. Your storefront must display this notice in compliance with UK rules, and the checkout flow will capture consent.

  • Faulty/failed supply: If access is not provided or the digital content is defective (e.g., cannot be streamed due to our fault), the customer is entitled to a refund or price reduction as prescribed by law.

5.3 Physical products (CDs, DVDs, Blu-rays, merchandise)

  • Marketplace role: Unless we state otherwise, you are the seller of record. You must provide customers with the statutory 14-day right to cancel from receipt for most goods (exceptions apply), plus the required information on returns and refunds. We may require you to use our standard returns policy template.

  • Faulty/not as described: Customers are entitled to statutory remedies (refund/repair/replacement) where goods are faulty or mis-described.

5.4 Timing & method of refunds

  • Where a refund is due, it will be made using the original payment method within the statutory time limits after (i) cancellation confirmation for digital services, or (ii) receipt of returned goods or proof of return for physical items, less any permitted deductions (e.g., unreasonable handling).

5.5 Events & livestreams

  • If a paid live event is cancelled or does not take place, customers are entitled to a refund of at least the ticket price (exclusive of optional extras) in accordance with industry practice and consumer law principles.

5.6 Compliance & enforcement

  • You agree to comply with UK consumer law (including the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015) in all customer-facing sales you conduct via EditHouse. We may process or require refunds on your behalf where required by law or platform policy. Note: upcoming rules under the Digital Markets, Competition and Consumers Act 2024 strengthen subscription protections (e.g., renewal cooling-off); we will update our flows and require your compliance as those provisions commence.

6. Licensing, Intellectual Property, and Regional Rights

  • You retain full ownership of the content you upload.

  • By submitting content, you grant EditHouse a non-exclusive, worldwide, royalty-free license to host, stream, reproduce, distribute, and promote your content solely for the operation of the platform.

  • If you have existing contracts or distribution agreements covering specific geographical regions, you may configure EditHouse’s built-in geographical restrictions to limit access to your content in those regions, ensuring compliance with your other obligations.

  • It is your responsibility to accurately set and manage these regional restrictions using the tools provided on the EditHouse platform.

  • You also grant EditHouse permission to use your film titles, artwork, thumbnails, and promotional materials for platform marketing purposes, unless explicitly prohibited by contract.

7. Limitation of Liability

  • EditHouse is not responsible for loss of revenue, business opportunities, data, or content due to outages, service interruptions, or removal of content.

  • We make no guarantees as to the uptime, performance, or viewership of any individual stream or video.

  • Use of the platform is at your own risk.

8. Changes to Terms

  • EditHouse may update these Terms and Conditions at any time. Updates will be communicated via email or platform notification.

  • Your continued use of the platform after changes are posted constitutes acceptance of the new Terms.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles.
You agree to submit to the exclusive jurisdiction of the courts located in the United Kingdom for the resolution of any disputes arising under or in connection with these Terms and Conditions.
